How Busted Mugshots Work in New Jersey

When a person is arrested in New Jersey, the booking process creates a record. That record holds the name, age, home address, charges, and date of arrest. A booking photo is taken at the jail. This is what most people call a mugshot. In New Jersey, these photos are not treated the same as other public records. Under N.J.S.A. 47:1A-1 et seq., the Open Public Records Act governs access to government files. But mugshots fall under a special rule.

Executive Order No. 69, signed in 1997, keeps fingerprint cards, plates, and photographs from criminal investigations out of public view. This means New Jersey treats busted mugshots as closed records. Law enforcement can share them in some cases, but the general public does not have the same access as in other states. Still, basic arrest data must be released. Under N.J.S.A. 47:1A-3(b), agencies must share the type of crime, the time and place, the name of the person charged, and bail information within 24 hours of an arrest in New Jersey.

So while you may not get the photo itself through a simple records request, you can still find detailed arrest records and criminal case data through official New Jersey tools.

New Jersey Busted Mugshots and Inmate Search

The NJ Department of Corrections Offender Information Portal is a key tool for finding busted mugshots and arrest data in New Jersey. The DOC search lets you look up people serving state prison terms of one year or more. You can search by name, SBI number, or physical traits like hair color and eye color. Results show the full name, current facility, admission date, parole date, and offense details for each person found in the New Jersey state system.

There are a few things to keep in mind. The DOC database only holds state prison inmates. County jail inmates are not in it. The data is updated every two weeks. People on work release or in halfway houses may not show up right away. Offenders are removed from the list one year after they finish their full sentence, unless they are on Community Supervision for Life or Parole Supervision for Life. Phone calls for inmate info are not accepted. You must write to the Department of Corrections at PO Box 863, Trenton, NJ 08625 for detailed records requests about New Jersey busted mugshots from the state system.

Note: County jail inmates serving less than one year are not in the NJDOC database and must be searched through county tools.

Criminal Court Records in New Jersey

Criminal case records in New Jersey tie directly to busted mugshots and arrest data. The PROMIS/Gavel Public Access system tracks cases from arrest through appeals in the Superior Court. PROMIS stands for Prosecutor Management Information System. You can search by name, indictment number, or complaint number. But only people who were convicted and sentenced will show up. Dismissed cases, PTI completions, and juvenile matters are not in the system.

Each county started using the system at a different time. Bergen County has data from December 1994. Other counties may have records starting later. The database updates daily. No sign-up is needed. Public access terminals are also set up at courthouses for people who prefer to search in person. Copy fees are $0.05 per letter page and $0.07 per legal page. Certified copies cost $15 in New Jersey.

New Jersey Criminal History and Busted Mugshots

The NJ State Police Criminal History Records section handles official criminal background checks. The State Bureau of Identification processes fingerprint-based checks under N.J.A.C. 13:59-1 et seq. New Jersey Sex Offender Registry and Busted Mugshots

The New Jersey Sex Offender Internet Registry is one of the few state tools that provides photos along with arrest and conviction data. It covers Tier 2 and Tier 3 offenders. Tier 1 offenders are not shown to the public. The registry is authorized under N.J.S.A. 2C:7-12 to -19, known as Megan's Law.

You can search by name, address, zip code, or a radius around a specific location. The registry shows the offender's name, address, aliases, offenses, risk level, physical description, photo, and vehicle info. County Prosecutor's Office Megan's Law Units verify this data. Misuse of registry data is a crime in New Jersey. Using it to commit an offense carries 3 to 5 years in prison and a $15,000 fine.

The registry cannot be used for housing or insurance decisions. It is meant only for public safety in New Jersey.

Filing OPRA Requests for Busted Mugshots

The Open Public Records Act gives you the right to request government records in New Jersey. The NJ OPRA Central portal is the main entry point for state agencies. Each request must be in writing. Signed and dated. Delivered to the right custodian. Agencies get 7 business days to respond. Fees run $0.05 per letter page and $0.07 per legal page. If the cost tops $25, a 50% deposit may be needed.

Keep in mind that criminal investigatory records are exempt from OPRA. Mugshot photos fall into this category under Executive Order No. 69. But basic arrest information, charges, and court disposition records are generally available in New Jersey. If a request is denied, you can appeal to the Government Records Council at 866-850-0511 or to Superior Court. The GRC can impose fines for violations: $1,000 for a first offense, $2,500 for a second, and $5,000 for a third within 10 years.

You can also submit OPRA requests to the NJ Office of the Attorney General for records held by that office. The request must go to the right custodian. Sending it to the wrong person means the 7-day clock does not start.

Note: New Jersey law under N.J.S.A. 2A:58D-4 prohibits anyone from charging money to remove busted mugshots from websites.

Not every county has an online tool. Hudson County, for example, requires phone calls for inmate info. Hunterdon County does not have its own jail and houses inmates in Warren County.
